Additional Terms for Apple App Store

Effective Date: October 2025

Acknowledgement

You acknowledge that these Terms are concluded between you and EMU exclusive travel GmbH only, and not with Apple Inc. ("Apple"). EMU exclusive travel GmbH, not Apple, is solely responsible for the golf.extra app and its content.

Scope of License

The license granted to you is limited to a non-transferable license to use the golf.extra app on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

Maintenance and Support

EMU exclusive travel GmbH is solely responsible for providing any maintenance and support services with respect to the golf.extra app, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.

Warranty

(1) EMU exclusive travel GmbH is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

(2) In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any) to you.

(3) To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app.

(4) Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of EMU exclusive travel GmbH.

Product Claims

(1) EMU exclusive travel GmbH, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app, including, but not limited to:

  • Product liability claims
  • Any claim that the app fails to conform to any applicable legal or regulatory requirement
  • Claims arising under consumer protection or similar legislation

(2) These Terms do not limit EMU exclusive travel GmbH's liability to you beyond what is permitted by applicable law.

Intellectual Property Rights

In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, EMU exclusive travel GmbH, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by these Terms.

Legal Compliance

You represent and warrant that:

(1) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country;

(2) You are not listed on any U.S. Government list of prohibited or restricted parties.

Third Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the app (e.g., if you have a VoIP application, then you must not be in violation of their wireless data service agreement when using the app).

Third Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

App Store Requirements

This app complies with:

  • Apple's App Store Review Guidelines
  • Apple's Human Interface Guidelines
  • Apple's Privacy Policy requirements
  • Apple's minimum functionality requirements

Updates and Changes:

(1) We may from time to time develop patches, bug fixes, updates, upgrades and other modifications to improve the performance of the app ("Updates").

(2) These Updates may be automatically installed without providing any additional notice or receiving any additional consent.

(3) You consent to these automatic Updates. If you do not agree, your only remedy is to stop using the app and delete it from your device.
